Truck Driver DWI Limits
The Federal Motor Carrier Safety Administration (FMCSA) sets a different legal intoxication limit on drivers with commercial driver’s licenses (CDLs) compared to other motorists. Under this rule, a truck driver is breaking the law when they are driving with a blood alcohol concentration (BAC) level of 0.04, rather than the usual 0.08. The lower BAC limit was established in recognition that it takes more effort and concentration to safely steer a big rig than a passenger vehicle.
When a truck driver has just one alcoholic beverage, they might experience:
- Worsened reaction time
- Blurred vision
- Inability to focus
- Unstable steering
- Poor judgment of distance and speed
- Heightened distractibility
Needless to say, a drunk trucker is more likely to cause a truck accident than one who is sober. If you have any reason to suspect that the truck driver who hit you is drunk, then you need to call the police immediately.

Police Evidence Could Bolster Your Case
The police should be involved in any truck accident caused by an intoxicated trucker. They will be working to find evidence that a prosecutor can use, but what they find might also help you. Our attorneys can network with local law enforcement agencies that investigated your crash to see if they have any evidence that proves the truck driver’s intoxication, which can spike their liability in a civil claim, too.
Police or law enforcement evidence we can use might include:
- Statements gathered at the scene of the crash
- Responding officer’s crash report
- BAC test results
- Conviction and sentencing details
